The Zoning Hearing Examiner (ZHE) has continued the Quik Trip Conditional Use Hearing to Tuesday, July 16th, requesting more information before making a decision. The hearing will happen via Zoom.  The agenda and link are at the bottom of this article. The more people who "attend" and comment, the better. It is important to let the community's opinions be known! QuikTrip cases "continued" to July 16. . .


The City's Zoning Hearing Examiner Robert Lucero has announced—in formal decisions published yesterday (Wednesday)—that consideration of QuikTrip's three proposed conditional uses will be continued to the ZHE's July 16, 2024, hearing.  Written comments for that July hearing must be submitted by 5:00 pm next Wednesday, July 10, 2024.  These are the three conditional uses that will make it possible for QuikTrip to operate a 24/7 truck fueling station, convenience store, and grab-and-go restaurant on 12th Street just south of I-40.    


Broadly speaking, the ZHE is allowing additional time for additional evidence to be submitted.  The decisions have several specific directives.  With respect to "heavy vehicle fueling," the ZHE is requiring QuikTrip to submit a "cumulative impacts analysis."  With respect to "nicotine retail" and "liquor retail," the ZHE is requesting additional evidence and "more robust analysis" of whether the uses are consistent with Albuquerque's Comprehensive Plan, and more evidence of mitigation conditions that would apply not only to QuikTrip, but to any future user of the property.  The ZHE also is requesting evidence that the nicotine sales at Walgreens are a "primary use."  The ZHE notes that the public has not had sufficient time to review QuikTrip's revised site plan.

In a bit of other QuikTrip news, three more neighborhood groups have joined the alliance of neighborhood groups and other organizations working with attorney Hess Yntema to oppose QuikTrip's proposed conditional uses and site plan.  The new groups are Downtown Neighborhoods Association, Sawmill Crossings Homeowners Association, and West Old Town Neighborhood Association.
